They are two brothers, Amara and Ounoussou, two brothers to whom the justice could dispute the French nationality. Two brothers, been born French in Senegal, but arisen from a father, nowadays deceased, who had the disadvantage of being a national of a former colony. During the decolonization father resided in France but his family remained living in the country of origin - a situation in which a recent Court of Cassation jusriprudence questions the French nationality.
The corporal Ounoussou Guissé, of the First Hussars-Parachutists' Regiment of Tarbes, had appeared on October 6th in front of the Rouen Court of Appeal to try to keep his French nationality and the right to serve his country. The court received an appeal of the public prosecutor's department against a decision, which gave reason to the young man, persistent on its ruling on November 18th. Having received in March, 2007 a mail of the county court of Strasbourg disputing its nationality, the elder brother of Ounoussou Guissé, Amara, 31 years old, the former corporal of the 12th artillery regiment of Oberhoffen found himself in a similar situation.
"Absurd", "improper", Minister of Defence, Hervé Morin, used words to provoke his indignantion at the situation, on Monday, October 12th, when he welcomed both brothers. In a video diffused on the site of the ministry, Mr Morin explains that - It is not proper to question their commitment - in the forces, and wonders that considering his national service in France - momentarily, nobody disputed the fact that Ounoussou possess the French nationality. -
There's no question of the military commitment. Both, the brothers Guissé distinguished themselves while serving in the forces; the elder brother by seven outside operations, a conscription followed by eleven years in the service as artilleryman, while as for the for the junior, his always true commitment in an elite Tarbes regiment drove him to Chad and to Afghanistan.
- Those are procedures more likely of the kafkian sort - that the Republic acts out, regrettably explains Mr Morin, adding -I've called up Minister of justice, Michèle Alliot-Marie at once -, whom he succeeded in the post of the ministry of defence, to announce him his "surprise". - Extremely sensitive to my initiative -, he assures, Lord Chancellor - will going to undertake, I presume, necessary steps so that such completely improper and absurd situations do not occur in the future. - And - in the hypothesis where the justice would come to refuse the French nationality to our two soldiers, a new procedure would be engaged and would allow them probably to see their recognized rights very quickly -, reassure the Minister.
The explanations of the Secretary of State, Jean-Marie Bockel, on - the possibility of depositing a naturalization request with the military authority - were wholeheartedly welcomed in the National Assembly by a thunder of protests in the opposition benches. The Minister of Immigration, Eric Besson, indicated on Tuesday evening that he - had asked his services to proceed with an attentive and friendly examination - of a possible request of naturalization of the brothers Guissé.
The Minister specifies in a communiqué that the Civil code offers three ways to Onoussou and Amara Guissé - if they wish to obtain the French nationality. As their brother Mamadou Guissé made it in 1998, they can deduce the "ownership of the french state for more than ten years." - They can however demand their naturalization at their department prefecture. Services accomplished in the French army are regularely taken into account. - Finally, - they can give evidence of exceptional services returned to France. -
